Any Way to stop an Illegal Foreclosure? Read this Horror Story!!!! Sheriff due today.

It seems unfathomable to me that this can happen IN AMERICA.  It sickens me to  see this kind of Callousness by loan service providers, and the court system.  How can either judge NOT issue a TRO just so things can be sorted out.  This story should go viral so please feel free to re-blog, to twitter the Original Article whose link is below.  According to the Story the Sheriffs are on a training day today, so they eviction will not occur until tomorrow.  I would love it if this could be stopped.  It must be stopped.

"H. Vincent and Theresa Price have lived in their home in Alameda for 32 years.  It’s where they raised their children.  They had always planned to leave it as their legacy.  They’ve NEVER been late on a mortgage payment… to this day!  And they never wanted or asked for a loan modification.

Yes, everything was just fine at the Price home… until last September… when their mortgage servicer, Specialized Loan Services, made a mistake in their accounting department.  A simple mistake… they didn’t credit the Prices for having made their August and September mortgage payments, even though they most certainly did, just like they always had, and on time too.  Incredibly, less than five months later they had lost their home to foreclosure."

OOHhhh-- I can see the lawsuit coming. How about market value and an extra million for a long list of add ons? The loan servicer is in deep dogie doo.

This is exactly what is so maddening about the multi-billion dollar bailout the mortgage industry has received. There was no increased watchdoggery, no new rules of engagement, nothing. There seems to be absolutely no common sence in this scenario and is is an egregious breach of due process. My suggestion to this poor couple would have been to immediately contact their state's representative as well as their governor. And, I agree with John, can you say humongeous lawsuit?

John you sure got that right.  I just hope they can find a way to keep the house

Tom I wonder how much money could have just gone to each american adult instead of all the bailouts.  it would have been a better way to throw away so much money

I guess what I'm wondering is how can they have been in the home for 32 years and still have a mortgage to pay?

I'm the attorney representing Mr. and Mrs. Price. I represent several homeowners who have lost or are losing their homes wrongfully. I truly appreciate Martin Andelman and his efforts to publicize this growing problem.

FYI, we received a two-week stay from the lockout for Mr. and Mrs. Price and are negotiating a longer stay pending the resolution of the civil action. Also, they were paying for 32 years because they refinanced once or twice.

Glad to hear it.  Zshonette I wish you the best of luck in what should not be happening in this country.  It is a black eye on America that your services are needed to protect people from such abuses
